They decided to flee to America, and respondent fears that if they return they will continue to be persecuted under the One Child policy.

Note: The Court granted asylum to respondent, a young female who faced persecution by the Chinese government for distributing Falun Gong literature to peers. Respondent first became involved with the religious philosophy not as a practitioner, but in an attempt to earn extra money for her struggling family. Her friend, who was also distributing the literature, was arrested and presumably tortured until she gave them respondent's name. Respondent recieved a warning from her friend and was advised to flee China immediately. Court found that this method of arbitrary arrest, detainment and torture is a sanctioned and common practice in China, where Falun Gong is considered a "political threat" by the government. Court also found that because the police continue to search for respondent and have harassed her family, she faces a clear probability of persecution and torture as an alleged Falun Gong practitioner should she be forced to return to China.
